Bids
Only those registered users who have made the deposit established by the Managing Authority may bid in an auction in auctions that require it.
When participating in an auction by placing your first bid, the Portal will ask you to indicate whether you will do so in your own name (the registered natural person), under a community property regime or on behalf of a third party. Subsequent bids will be deemed to have been made with the same characteristics as the first bid.
No. Bids that have been confirmed on the Auction Portal cannot be withdrawn or modified. Therefore, it is essential that before confirming a bid you carefully review the details of the bid you are going to confirm.
If during the bidding process you indicate that you wish to reserve your bid, your deposit will be retained at the end of the auction bidding period, even if your maximum bid has been exceeded by another bidder, until the auction is awarded and finalized by the Managing Authority. In the event that the highest bidders are not ultimately awarded the contract, the Auction Managing Authority will appoint the second or subsequent highest bidder who requested that his or her bid be reserved as the new awardee.
The Portal will ask the bidder once if they wish to reserve their maximum bid. It will be at the time of the first bidder's bid at the auction. Once you place a bid indicating that you wish to place a reserve bid, all subsequent bids in the same auction will be placed with a reserve bid. Likewise, once you place a bid indicating that you do NOT wish to place a reserve, all subsequent bids in the same auction will be made without a reserve bid.
If you wish to place a bid for a value less than or equal to the maximum bid, the system will only allow this if you also accept a reservation of your bid until the auction is awarded, since you can only become the final winner if the bidders with the highest bids renounce the award.
The Auction Portal will send you the following information notices regarding the progress of the auction:
- If you are the highest bidder at any given time, you will be notified the first time your bid is outbid by another bidder. If the bid is outbid again, only the new highest bidder at that time will be notified.
- If you have participated in the auction in any way (by placing a deposit, bidding, or both), you will be sent a notice when the bidding period ends. In addition, if you have placed reserve bids, you will be sent a certificate of your best bid at the end of the auction.
- If you have requested it on the Portal through your searches, you will be sent a notice with the start of the bidding period for the corresponding auctions.
Participation in an auction has two different parts that must be carried out by the same user of the Auction Portal.
- Constitution of the deposit . You can make the deposit with the bank account you want as long as it meets these conditions:
- Belong to one of the AEAT's collaborating entities.
- That the user who performs the operation on the Portal (you in this case) is either the account holder or a representative authorized in the account (if the holder is a company).
- No joint signature required if there is more than one holder
- Placing the bid . In one of the steps of placing a bid, the Portal will ask you to indicate how you are acting, i.e. on whose behalf you are acting. At that point, you must indicate that you are acting in whole or in part on behalf of a third party. The Portal will ask you for the details of the third party you are representing, who will be the one in whose name the bid will be made and who will be awarded the property, if you are the winner.
You can identify yourself on the Portal using your representative certificate or a personal certificate, but regardless of how you have identified yourself on the Portal, to make a bid on behalf of a company, you must always indicate this at the time of making the bid, when the Portal asks you to indicate your form of action (personal, jointly owned or on behalf of third parties). In order for the bid certificate to be issued in the name of the company, it is essential that you indicate at that time that you are acting on behalf of a third party (in this case the company). If you do not make this indication, the bidding certificate will be issued only in your name and not in the name of the company.
Yes, the starting price or minimum bid for the auctioned item or lot will be 10% of the auction price, unless these items or lots have a charge greater than or equal to 25% of the valuation amount, in which case there will be no minimum bid.
